Regulators face the challenge of crafting policy that preserves these opportunities while managing risks, and that encourages invention across the board, from hobbyists to large enterprises.

Why Open Source Needs a Seat at the Table

Open source is the bedrock of software innovation, present in an estimated 96% of codebases. Yet policymakers often misunderstand its economics, its risks, and the unintended consequences of poorly targeted regulation. GitHub has pushed for balanced treatment of open source in recent EU legislation, including the AI Act and the Cyber Resilience Act, lobbying for clear exemptions so that open source development is not inadvertently chilled.
